How we collect, use, and disclose your personal information - and the choices and rights you have over it.

This Privacy Policy describes how KSTC, Inc. and its affiliates, including Commers Medical Associates, P.A. and affiliated professional practices (collectively, “june/july,” “we,” “us,” “our”) collects, uses and discloses information about you when you use our website (https://junejuly.health/#about), applications, services, tools and features, or otherwise interact with us (collectively, the “Services”). Please note that the Services are designed for users in the United States only and are not intended for users located outside the United States.

Please note that at certain times, we may process your protected health information (“PHI”) that is subject to the Health Insurance Portability and Accountability Act, as amended (“HIPAA”). This Privacy Policy does not apply to PHI subject to HIPAA. For more information on how we collect, use, and disclose PHI, please see our Notice of Privacy Practices.

Please read this Privacy Policy carefully. By using any of the Services, you agree to the collection, use and disclosure of your information as described in this Privacy Policy. If you do not understand or agree to this Privacy Policy, please do not use or access the Services.

1.CHANGES TO THIS PRIVACY POLICY

We may modify this Privacy Policy from time to time, in which case we will update the “Last Updated” date at the top of this Privacy Policy. If we make material changes to how we use or disclose information we collect, we will use reasonable efforts to notify you (such as by emailing you at the last email address you provided us or by posting notice of such changes on the Services) and will take additional steps as required by applicable law. If you do not agree to any updates to this Privacy Policy, please do not continue using or accessing the Services.

2.COLLECTION AND USE OF INFORMATION

When you use or access the Services, we collect certain categories of information about you from a variety of sources. In addition to the specific uses discussed below, we may use this information to provide and improve the Services and to maintain our business relationship, including by enhancing the safety and security of our Services, providing customer support, complying with applicable legal obligations, enforcing any applicable terms of service and protecting our rights and the rights of our employees, users or other individuals.

Information You Provide to Us

Some features of the Services may require you to directly provide certain information, including information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features and Services. Information that you directly submit through our Services includes:

  • Contact information, such as your name, date of birth, address, sex, gender, phone number, and email address. We use this information to create and maintain your account and provide the Services and to communicate with you (including treatment-related communications).
  • Account information, such as username and password. We use this information to provide the Services and to create, maintain and secure your account with us. If you choose to register an account, you are responsible for keeping your account credentials safe. We recommend you do not share your access details with anyone else. If you believe your account has been compromised, please contact us immediately.
  • Appointment booking information, such as appointment booking requests you submit through the Services. We use this information to process your appointment booking requests.
  • Payment and subscription information, such as bank account, credit or debit card information, and billing address, which is collected on our behalf by our payment processor and information about your subscription tier and transaction history. We use this information to process your payment and provide the Services and to provide you with different account features and options.
  • Treatment preferences and survey responses, such as your responses to surveys about your treatment preferences and your communication preferences. We use this information to personalize your treatment, to communicate with you in accordance with your preferences, and to personalize your overall experience.
  • Applicant details, such as information included in your resume or CV, references, and job history. We use applicant details to process your application for employment and to evaluate your candidacy.
  • Any other information you choose to provide to us or otherwise include in communications with us, for example, when sending a message through the Services.

Information Collected Automatically

We and third parties also automatically collect certain information about your interactions with the Services, including through cookies, pixels or other tracking technologies (“Tracking Technologies”). This information is collected and used to personalize the Services for you, to target, deliver and measure interest-based marketing of june/july services, to tailor your experience with the Services, provide you with offers or promotions, run analytics, and better understand user interactions with the Services. Such information may include:

  • Device information, such as device type, operating system, and internet protocol (IP) address.
  • Location information, such as approximate location based on IP address and, if you choose to provide it, your precise geolocation.
  • Other information regarding your interaction with the Services, such as browser type, log data, date and time stamps, interactions with marketing emails and ad impressions.
  • Unique identifiers, such as advertising IDs, cookie IDs, and pixel IDs assigned by third-party advertising platforms.
  • Browsing activity, such as pages visited, links clicked, content viewed, and actions taken on the Services (e.g., form submissions or searches).

Information Collected from Other Sources

We may obtain information about you from outside sources, including information that we collect directly from third parties and information from third parties that you choose to share with us. Such information includes:

  • Information we receive when you choose to access the Services through your email account or link any social media platforms to your account, such as Google, Facebook or Apple, which we use to maintain your account and login information. These partners provide information such as your name, email address and additional account information that is publicly available.
  • Health-related information we receive from third-party sources, such as Apple HealthKit data (such as heart rate, blood pressure, sleep activity). Please note that this information, including prescription history and medical records, may be PHI which is subject to our HIPAA Notice of Privacy Practices.
  • Information from identity verification providers.

Any information we receive from outside sources will be treated in accordance with this Privacy Policy. We are not responsible for the accuracy of the information provided to us by third parties and are not responsible for any third party’s policies or practices. Deidentified Information

Finally, we may deidentify or anonymize your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you (“deidentified information”) (or we may collect information that has already been deidentified/anonymized), and we may use deidentified information for any purpose. To the extent we possess or process any deidentified information, we will maintain and use such information in deidentified form and not attempt to re-identify the information, except for the purpose of determining whether our deidentification process satisfies legal requirements.

3.COOKIES AND OTHER TRACKING TECHNOLOGIES

As described above, we and third parties use Tracking Technologies to collect certain information about your interactions with the Services. Most browsers accept Tracking Technologies automatically, but you may be able to control the way in which your devices permit the use of certain Tracking Technologies. If you so choose, you may block or delete certain Tracking Technologies from your browser; however, blocking or deleting cookies may cause some of the Services, including login features and general functionality, to work incorrectly.

Your browser settings may allow you to transmit a signal or other mechanism for exercising your choice regarding the collection or processing of your information when you visit various websites.

4.SMS TEXT MESSAGES

In the course of using our Services, you may receive SMS text messages from us, to the extent you opt in to receive such messages. These messages may be used for purposes such as appointment scheduling and reminders. The SMS message itself does not contain any details about your treatment or health information; all treatment-specific content is accessible only after identity verification on our secure platform. Message frequency varies based on your treatment plan.

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a single confirmation message acknowledging your request, and you will not receive further messages unless you re-subscribe. Standard message and data rates from your mobile carrier may apply. For help with our messaging service, reply HELP to any message or contact us using the information below.

5.DISCLOSURE OF YOUR INFORMATION

The disclosures described in this section relate to your personal information collected through your use of our website and the Services, and not to your PHI as defined under HIPAA. Your PHI is used and disclosed only as described in our HIPAA Notice of Privacy Practices and in accordance with applicable law. We may disclose your personal information for legitimate purposes subject to this Privacy Policy, including:

  • Vendors or other service providers who help us provide the Services including for system administration, identity verification, cloud storage, security, customer relationship management, marketing communications, analytics, payment networks, payment processing, and the deployment of Tracking Technologies.
  • Healthcare providers and family members that you authorize.
  • Our affiliates or others within our corporate group.
  • Professional advisors, such as auditors, law firms, or accounting firms.
  • Third parties in connection with or anticipation of an asset sale, merger, acquisition, or other business transaction, including in the context of a bankruptcy proceeding or other restructuring matter.
  • For legal and security reasons and to protect our services and business, including to cooperate with law enforcement, judicial orders and regulatory inquiries, to detect and prevent against fraudulent or illegal activity, to exercise or defend legal claims, and to ensure the safety and security of our business, employees and users, and to enforce our terms or other agreements.
  • Other third parties with your consent or at your direction. .

6.THIRD-PARTY WEBSITES AND MATERIALS

We may provide links to third-party websites or platforms and display or make available content, data, applications or materials from third parties. If you follow links to sites or platforms that we do not control and are not affiliated with us, you should review the applicable privacy notice, policies and other terms. We are not responsible for the privacy or security of, or information found on, these sites or platforms, or the accuracy, completeness or reliability of third-party materials. Information you provide on public or semi-public venues, such as third-party social networking platforms, may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.

7.MINORS’ PRIVACY

Our Services are not intended for minors, and we do not seek or knowingly collect any personal information about individuals under the age of 18. If we become aware that we have unknowingly collected information about an individual under the age of 18, we will make commercially reasonable efforts to delete such information from our database. If you are the parent or guardian of an individual under 18 years of age who has provided us with their personal information, you may contact us using the below information to request that it be deleted.

8.DATA SECURITY AND RETENTION

We have implemented commercially reasonable security measures designed to protect your personal information from unauthorized access, use or disclosure. However, despite our efforts to protect your information, no security measures are impenetrable, and we cannot guarantee “perfect security.” Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.

We retain your information for as long as is reasonably necessary for the purposes specified in this Privacy Policy. When determining the length of time to retain your information, we consider various criteria, including whether we need the information to continue to provide you the Services, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity or protect ourselves, including our rights, property or products.

9.PRIVACY RIGHTS

Depending on where you live, you may have certain rights in relation to your personal information. However, please note that a number of these rights only apply in certain circumstances, and all of these rights may be limited by law.

  • Access / Know: You may have the right to request access to the personal information we hold about you and to obtain details about what personal information we have collected about you, including the categories of personal information, the categories of sources from which the information was collected, the business or commercial purposes for collecting, personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you. You may also request to obtain a list of specific third parties, other than natural persons, to which we have disclosed your personal information.
  • Deletion: You may have the right to request that we delete personal information we hold about you.
  • Correction: You may have the right to request that we correct inaccurate personal information we hold about you.
  • Portability: You may have the right to receive a copy of the personal information we hold about you in a portable and, to the extent technically feasible, readily usable format.
  • Opt-Out of Marketing: You may opt out of marketing at any time by using the unsubscribe / opt-out instructions provided in our communications to you. If you opt out, we may still send you transactional or administrative messages, such as emails about your account.
  • Opt-Out of Data Processing for Targeted Advertising. You may have a right to direct us not to share your personal information with our paid advertising partners or share or process your personal information for targeted advertising. We will not retaliate or discriminate against you for exercising any of these rights. Further information may be needed to verify your identity before exercising these rights, such as your email address or government issued ID. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. If we deny your request, you may have the right to appeal our decision by contacting us through the methods described in the section below, How to Contact Us.

When you submit a request or launch an appeal, we will limit our collection of your information to only what is necessary to securely fulfill your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal.

10.CALIFORNIA RESIDENTS

We provide California residents with the ability to opt out of the disclosure of their personal information to third parties for the third parties’ direct marketing purposes under the California “Shine the Light” law at no cost. To exercise this right, please contact us using the information listed below.

11.WASHINGTON AND NEVADA CONSUMER HEALTH DATA

Depending on where you live, we may process your consumer health data subject to the Washington My Health My Data Act and the Nevada Health Privacy Act (collectively, “State Health Data Laws”). “Consumer health data” is personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status.

To provide our products, services, or features we collect and process information about you, including information that could be considered Consumer Health Data. The information we collect depends on how you interact with us and use the Services, as described further in the “Collection and Use of Information” section of our Privacy Policy. This may include information about individual health conditions, diagnoses, treatments, medications, surgeries or procedures, reproductive or sexual health, gender-affirming care, bodily functions, vital signs, symptoms, social or psychological interventions, and precise location information that could reasonably indicate an attempt to acquire or receive health services or supplies.

We collect consumer health data directly from you (including through your interactions with our website and Services), from your device(s), and from partners, vendors, and third parties. We use consumer health data as reasonably necessary to provide you with the Services you have requested, including to personalize and improve the Services, to provide measurement and analytics, to promote safety, integrity, and security, to communicate with you, and to comply with our legal obligations. We do not sell consumer health data, and we do not permit third parties to collect consumer health data over time and across different websites or online services when you use our Services.

We may disclose consumer health data to service providers, healthcare providers you authorize, affiliates, professional advisors, third parties in connection with a business transaction, and law enforcement or other parties as required by law or to prevent harm, in each case as reasonably necessary to provide the Services or with your consent or authorization. Under the State Health Data Laws, you may have certain rights with respect to your consumer health data, including the right to confirm whether we are collecting or disclosing your consumer health data and with whom, the right to access such data, the right to withdraw your consent for the collection or disclosure of your consumer health data, and the right to request corrections.
